About These Terms

These Terms & Conditions apply to modelling, photography, videography, TFP, creative collaborations, promotional work and other projects where I participate as a model. They are intended to keep expectations clear while allowing projects to remain creative and collaborative. Specific booking details, including the date, location, concept, duration, fee, deliverables and intended use of content, may be agreed separately in writing. These Terms are separate from any invoice. An invoice relates to payment for a particular booking and does not, by itself, provide additional rights to use my image or likeness.
 

Bookings & Payment

A booking may be confirmed by written agreement, message, signed agreement, payment or otherwise agreeing to proceed. For paid modelling, the agreed fee and payment terms will generally be provided by separate invoice. Additional hours, travel, expenses or substantially different work should be discussed and agreed beforehand where reasonably possible. For TFP or unpaid collaborations, no modelling fee is payable unless otherwise agreed.
 

TFP & Collaborations

TFP and collaborations are generally undertaken for mutual creative and portfolio benefit. Before the project, we should have a reasonable understanding of the concept, what each person is contributing and what content I will receive. Unless otherwise agreed:

• Each person is responsible for their own agreed expenses.

• Final image selection may remain with the photographer or creative team.

• Delivery times may vary.

• TFP does not provide unlimited rights to use my image or likeness.

• Commercial use, paid advertising or third-party licensing requires separate agreement.

Being an unpaid collaboration does not remove the need for consent, boundaries, safety or respectful conduct.
 

Consent & Boundaries

My consent and personal boundaries must be respected throughout the booking. I may decline or change my mind about any pose, outfit, activity, physical contact, concept or request. Consent can be withdrawn at any time, and I should never be pressured to continue with something I have declined. Agreeing to one part of a project does not automatically mean I have agreed to anything outside what was discussed.
 

Nudity & Unintended Exposure

I do not participate in nude or implied-nude modelling. I do not agree to intentionally pose nude, partially nude, topless, bottomless or in a way that exposes intimate areas. If an image captures unintended exposure, including a wardrobe malfunction or a body part that I did not intentionally agree to show, the image must be checked with me and deleted or otherwise approved by me before it is posted, published, submitted, shared or otherwise used publicly. This includes accidental breast, nipple, under-breast, buttock or intimate-area exposure. I may request that an image not be used, or that it be cropped or edited, where it contains unintended exposure. Consent to an outfit or pose does not constitute consent to accidental exposure.
 

Physical Contact & Safety

Physical contact must be appropriate to the agreed concept and consented to by me. I may ask for any pose, activity or interaction to stop at any time. Everyone involved is expected to behave respectfully and take reasonable care of themselves and others. Any unusual or higher-risk activity or location should be discussed before the booking.
 

Image, Video & Likeness Usage

I understand that the photographer or videographer will generally own copyright in the work they create. However, being photographed or filmed does not automatically grant unlimited rights to use my image or likeness. Unless otherwise agreed, content featuring me may be used for reasonable portfolio and social media purposes connected with the project. If I have a genuine privacy, safety, personal or reasonable reputational concern about a particular photograph or video, I may request that it be removed from public use. The photographer, videographer or other person responsible will consider the request in good faith and, where reasonably able, remove or stop using the relevant content.

This does not automatically transfer copyright ownership or guarantee removal where content has already been published, supplied to a third party, included in a completed publication or where removal is not reasonably practical. However, reasonable requests will be considered and accommodated where possible.

Any image containing unintended exposure must be checked with me before being posted, published, submitted, shared or otherwise used publicly.

The following require separate discussion and agreement:

• Paid advertising

• Commercial campaigns

• Product packaging

• Merchandise

• Stock photography

• Third-party licensing

• Endorsements

• Political or advocacy material

• Sexual or explicit content

• AI or synthetic content

• Other substantially different uses

 

Permission for one purpose does not automatically grant permission for another.

Editing & Representation

Normal editing, colour grading, cropping and retouching are expected. My image must not knowingly be altered or presented in a misleading, defamatory or harmful way, or used to suggest that I participated in something I did not. Any significant edit that creates nudity, sexual content or unintended exposure must not be published without my prior agreement.

 

AI & Synthetic Media

Unless I expressly agree otherwise in writing, content featuring me must not knowingly be used for:

• AI or machine-learning training

• Dataset creation

• Facial-recognition datasets

• Generative AI

• Digital avatars

• Deepfakes

• Synthetic versions of my likeness

• AI-generated sexual or explicit content

• Data scraping

• Similar purposes involving artificial reproduction of my likeness

This applies to finished content and original files containing my likeness.
 

Portfolio, Social Media & Behind-the-Scenes

I am generally happy for agreed content to be shared for reasonable portfolio and social media purposes. Where practical, appropriate credit is appreciated @darkside.fairy

Behind-the-scenes content is acceptable where appropriate to the project, but I must not be photographed or recorded in changing areas, bathrooms or other places where there is a reasonable expectation of privacy. Any commercial use of behind-the-scenes content should be agreed separately.
 

Privacy

Personal information provided for a booking should be treated respectfully and used only for legitimate purposes connected with the project. My private information, including my home address, personal contact details or sensitive information, must not be publicly shared without my permission unless required by law.
 

Cancellations & Rescheduling

I will provide reasonable notice if I need to cancel or reschedule. If another party cancels at short notice, any agreed payment, deposit, travel reimbursement or other arrangements will depend on the booking agreement. Reasonable expenses incurred specifically for a cancelled project may be discussed for reimbursement. Repeated cancellations, no-shows or significant last-minute changes may affect future bookings.
 

Travel & Expenses

Travel, accommodation and significant expenses should be discussed and agreed before the booking. Unless otherwise agreed, each party is responsible for their own expenses.
 

Professional Conduct

I will make reasonable efforts to be punctual, prepared and professional, and I expect the same from everyone involved. I may decline or end a booking if there is:

• Harassment or bullying

• Threatening or intimidating behaviour

• Discrimination

• Unwanted sexual attention

• Repeated boundary violations

• Unsafe conduct

• A significant unwanted change to the agreed project

My safety and wellbeing come first.
 

Exclusivity & Confidentiality

Unless specifically agreed in writing, working with a photographer, creative, brand or agency does not create exclusivity.

I remain free to work with other people and businesses. I will respect reasonable confidentiality relating to unreleased projects and expect the same treatment of my personal information and private communications.
 

Force Majeure

Neither party will be responsible for delays or cancellations caused by circumstances genuinely outside their reasonable control, including serious illness, injury, emergencies, severe weather, natural disasters, transport disruptions, venue closures or government restrictions. Where possible, the affected person should provide reasonable notice and discuss rescheduling.
 

Disputes & Liability

If an issue arises, both parties should first make a reasonable attempt to resolve it through clear and respectful communication. Each person remains responsible for their own conduct, equipment and obligations. Nothing in these Terms excludes, restricts or modifies any rights, guarantees or remedies that cannot legally be excluded or limited under Australian law, including the Australian Consumer Law where applicable.

Governing Law & Acceptance

These Terms are governed by the laws of Queensland, Australia. By signing these Terms, confirming a booking, agreeing to proceed after receiving them, making or accepting payment, or participating in a project after receiving them, the parties acknowledge that they have read and agreed to these Terms to the extent permitted by law. Any changes or special arrangements should be confirmed in writing. If any provision is found to be invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
 

I want modelling to be creative, respectful, safe and enjoyable for everyone involved. These Terms are simply here to make sure expectations, boundaries and image usage are clear before we create together. Thank you for respecting my time, privacy, boundaries and contribution as a model.
